1. Agreement to Terms
By accessing or using JusTix (Service, Platform, we, us, or our), you agree to be bound by these Terms of Service (Terms). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, event organizers, and others who access or use the Service.
2. Account Registration
2.1 Account Creation
You must create an account to purchase tickets or become an event organizer. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
2.2 Identity Verification
Event organizers must complete identity verification. We may request additional documentation to verify your identity and comply with legal requirements.
2.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.
3. Ticket Purchases
3.1 Purchase Process
When purchasing tickets:
- All sales are processed through our secure payment provider (Yoco)
- Prices are displayed in South African Rand (ZAR) and include all applicable fees
- You will receive email confirmation upon successful purchase
- Tickets become available for viewing 3 hours before the event start time
3.2 Ticket Ownership and Transfer
Tickets are linked to your personal identity QR code. This means:
- Each account has one unique QR code for event entry
- Sharing your QR code grants access to ALL your tickets for ALL events
- Unauthorized ticket transfers or resale is prohibited
- We are not responsible for tickets obtained through unauthorized means
3.3 Platform Fees
The total price includes the ticket price and applicable platform service fees. All fees are clearly displayed before purchase completion.
4. Refunds and Cancellations
4.1 Event Cancellation
If an event is cancelled by the organizer:
- Full refunds will be processed to the original payment method
- Refunds may take 5-10 business days to appear
- You will be notified via email of the cancellation and refund
4.2 Purchaser Cancellation
Ticket sales are generally final. Refund eligibility is determined by:
- The event organizer's refund policy
- Timing of the cancellation request
- Circumstances beyond your control (medical emergencies, etc.)

5. Event Organizers
5.1 Organizer Application
To become an event organizer, you must:
- Submit a complete application for review
- Verify your identity and provide requested documentation
- Comply with all applicable laws and regulations
- Wait for admin approval before creating events
5.2 Event Creation and Management
As an organizer, you agree to:
- Provide accurate event information and comply with event listing requirements
- Honor all ticket sales and fulfill event obligations
- Comply with venue requirements, permits, and insurance requirements
- Maintain appropriate licenses for your event type
- Not discriminate against any ticket purchaser based on protected characteristics
5.3 Payout Terms
Event revenue is subject to:
- Platform service fees as agreed upon event creation
- Payment processing fees (absorbed by platform)
- Payout holds for fraud prevention (if applicable)
- Withholding for pending refunds or disputes
6. Prohibited Conduct
You may not:
- Use the Service for any illegal purpose or in violation of any laws
- Impersonate any person or entity or falsely state your affiliation
- Attempt to gain unauthorized access to the Service or other accounts
- Scrape, spider, or use automated means to access the Service
- Upload viruses, malware, or any harmful code
- Engage in ticket scalping, fraud, or unauthorized resale
- Forge or manipulate QR codes or tickets
- Share your account credentials or identity QR code
- Interfere with the proper functioning of the Service
- Harass, abuse, or harm other users or organizers
7. Intellectual Property
7.1 Platform Content
The Service and its original content (excluding user-provided content), features, and functionality are owned by JusTix and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 User Content
By posting event information, images, or other content:
- You retain ownership of your content
- You grant us a worldwide, non-exclusive license to use, display, and promote your content
- You represent that you have all necessary rights to the content
- You agree not to upload copyrighted material without permission
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Events will occur as scheduled or meet your expectations
- Any errors in the Service will be corrected
- The Service is free from viruses or harmful components
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability.
10. Indemnification
You agree to indemnify, defend, and hold harmless JusTix, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
11.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation fails
- Binding arbitration in accordance with South African law
- South African courts shall have exclusive jurisdiction for any matters not resolved through arbitration
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via:
- Email notification to your registered email address
- Prominent notice on the Platform
- Updated "Last Updated" date at the top of this page
Your continued use of the Service after changes constitutes acceptance of the modified Terms.
